Joint resolution authorizing the first amendment to the Amended and Restated Agreement for Retail Sanitary Sewer Service between Lake County and the Village of Hawthorn Woods.

• The County and the Village of Hawthorn Woods entered into an Amended and Restated Agreement for Retail Sanitary Sewer Service, dated April 8, 2025.

• The Village desires to amend the agreement to offer sanitary sewer service to a 56-acre property designated as “Kemper Ridge”, which will consist of residential development.

• The County’s extension of retail sanitary sewer service will ensure continued sanitary sewer collection, transportation, and treatment to the areas of the Village to be served under this agreement.

• The Village of Hawthorn Woods is scheduled to act on the amended agreement at the Village Board meeting on December 16, 2025.

• The County has determined that, subject to the agreed terms and conditions in the agreement and amendment, the new properties are feasible for the purpose of constructing the residential development.

• This resolution authorizes execution of the first amendment of the Amended and Restated Agreement between the County and the Village of Hawthorn Woods.

• In accordance with County Board Rules, the State’s Attorney’s Office has reviewed this first amendment to the Agreement prior to action by the County Board.

Joint resolution authorizing the execution of the first amendment to the Restated and Amended Agreement for Sewage Disposal between Lake County and the Village of Lake Villa (Village).

• The County and the Village entered into a Restated and Amended Agreement for Sewage Disposal, dated January 14, 2025.

• The County Board approved the Transfer of Former Lakes Region Sanitary District Assets and Responsibility Policy dated May 12, 2024, which outlined the process for transferring sanitary sewer assets and responsibilities, which the County assumed as a result of the dissolution of the former Lakes Region Sanitary District.

• The Village submitted a request to the County to transfer the ownership and operations of sanitary sewer assets within the Prairie Trails Subdivision and the Phase 1 and Phase 2 of Cedar Ridge Subdivision, all located within the Village boundaries.

• The request was reviewed and found to be in accordance with the policy by the Department of Public Works and the County Administrator’s office.

• The transfer of sanitary sewer assets to the Village of Lake Villa would provide for the Village to own, maintain and manage the sanitary sewer collection system in these neighborhoods.

• The Village of Lake Villa approved the Amendment to the Agreement on October 20, 2025.

• This resolution authorizes the execution of the Amendment between the County and the Village of Lake Villa to allow for this transfer of assets and to reflect as such in the agreement service area.

• In accordance with County Board Rules, the State’s Attorney’s Office has reviewed this Intergovernmental Agreement prior to action by the County Board.

Joint resolution authorizing a contract with Copenhaver Construction, Inc., Union, Illinois, in the amount of $4,421,079.17 for non-motorized improvements along Washington Street, from Sextant Drive to Almond Road, and appropriating $5,305,000 of County Option Motor Fuel Tax funds.

• The improvements include installing a new bike path along the south side of Washington Street from Mainsail Drive to United States Route 45, and on the north side of Washington Street from United States Route 45 to Almond Road.

• The improvements also include installing new sidewalk along the north side of Washington Street from Sextant Drive to Mainsail Drive, and along the south side of Washington Street from Tangueray Drive to Almond Road.

• There was a public call for bids, and a total of seven bids were received, ranging from $4,421,079.17 to $5,359,516.20 and the lowest responsible bidder is Copenhaver Construction, Inc., Union, Illinois, in the amount of $4,421,079.17.

• This project is included in the Transportation Improvement Program with construction to begin in 2026 and designated as Section 21-00110-15-BT.

Joint resolution authorizing a contract with Berger Contractors, Inc., Wauconda, Illinois, in the amount of $2,867,174.87 for the intersection improvements of Deep Lake Road at Depot Street, and appropriating $3,555,000 of County Option Motor Fuel Tax funds.

• The intersection improvements of Deep Lake Road at Depot Street will include the installation of a roundabout and non-motorized improvements.

• The project will require a 100-day closure at the intersection to construct the roundabout.

• The contract includes incentives to the contractor for opening the intersection early and disincentives if the closure goes beyond 100 days. Reducing the duration of the closure is a direct benefit to the public including motorists, residents, first responders, and area schools.

• There was a public call for bids, and a total of six bids were received, ranging from $2,867,174.87 to $3,559,584.56 and the lowest responsible bidder is Berger Contractors, Inc., Wauconda, Illinois, in the amount of $2,867,174.87.

• This project is included in the Transportation Improvement Program with construction to begin in 2026 and designated as Section 19-00132-05-CH.
