Village of Zurich Board of Trustees met November 20.

Here is the minutes provided by the Board:

1. Call To Order by Mayor Thomas M. Poynton at 7.00 pm.

2. Roll Call Mayor Thomas Poynton, Trustee Jim Beaudoin, Trustee Mary Beth Euker, Trustee John Shaw, Trustee Marc Spacone, Trustee Greg Weider. Trustee Jonathan Sprawka was absent and excused. Also present: Village Manager Ray Keller, Asst. Village Manager Roy Witherow, Village Atty. Scott Uhler, Finance Dir. Jodie Hartman, Dir. of Innovation Michael Duebner, Police Chief Steve Husak, Fire Chief John Malcolm, Public Works Dir. Mike Brown, Deputy Fire Chief Rick Johnson, Division Chief John Kelly, Deputy Fire Marshall Tom Harden.

4. Public Comment

Geoff Petzel, 695 Windermere Lane, addressed the Board on major inconsistencies in the permitting process and there needs to uniformity. Mr. Petzel demanded the termination of Manhard Consulting as Engineers because of a conflict of interest in the proposed Lifetime Fitness facility who have hired Manhard Consulting for the project. Marty Filson, 33 E. Harbor Dr., addressed the Board on the responses to his questions at the last meeting. There was no back up information provided.

5. Presidents Report / Community Update

A. Oath of Office for Firefighter / Paramedic David Santoyo: Fire Chief John Malcolm gave background information his career. Marty Bush, Fire Commissioner, administered the Oath of Office and Lt. Santoyo's wife pinned him.

B. LZHS Football team: the team will play in the State 7A finals in DeKalb on

Saturday Versus Batavia.

C. Girl Scout Scarecrows Recognition: Mayor Poynton recognized the many GSA Troops, Brownies and Daisies who helped decorate Main Street with Scarecrows. The girls received certificates from the Mayor.

D. Miracle on Main Street: Mayor Poynton reminded residents of the celebration on Main Street on Saturday, December 2nd from 3-7pm. BSA Troop #92 will be collecting Hats, Gloves and Coats.

6. Truth-In-Taxation Public Hearing For, 2017 Property Taxlevy

Summary: The total proposed increase to the Village of Lake Zurich property tax levy is 3.17%, an increase of $287,771. This levy increase brings the total levy to $9,366,105. As the proposed property tax levy for 2017 will not exceed 105% of the actual 2016 property tax extension, the Village is not required to hold a Truth in Taxation Public Hearing on the property tax levy.

To promote the transparency of local government operations in the Village of Lake Zurich, this Truthin-Taxation hearing has been scheduled so the public can have the opportunity to comment on the proposed increase. The hearing notice was published on November 10, 2017 in the Daily Herald.

Recommended Action #1: A motion was made by Trustee Beaudoin, seconded by Trustee Spacone, to open the Truthin-Taxation Public Hearing for the 2017 Property Tax Levy and receive public comments into record.

Ayes: 5 Trustees Beaudoin, Euker, Shaw, Spacone, Weider.

Nays:0

Absent: 1 Trustee Sprawka.

Public Comment

Marty Filson, 33 E. Harbor Dr., addressed the hearing on the residents being already taxed with water rates and utility taxes and asked for reduced expenses instead.

Geoff Petzel, 695 Windermere Lane, addressed the hearing and challenged the line items.

Mayor Poynton closed Public Comments.

Recommended Action #2: A motion was made by Trustee Weider, seconded by Trustee Shaw, to close the Truthin-Taxation Public Hearing for the 2017 Property Tax Levy.

Ayes: 5 Trustees Beaudoin, Euker, Shaw, Spacone, Weider.

Nays: 0

Absent: 1 Trustee Sprawka.

7. Consent agenda

A. Approval of Minutes of the Village Board Meeting, November 6, 2017

B. Semi-Monthly Warrant Register Dated November 20, 2017 Totaling $629,790.51

C. Resolution Approving Release of Executive Session Meeting Minutes RES. #2017-11-015

Summary: The Village is required to conduct periodic reviews of Executive Session minutes for the purpose of determining whether any minutes may be released for public viewing. The proposed Resolution clarifies the executive session minutes that the Board has provided consensus on to either keep confidential or release.

D. Ordinance Authorizing Disposal of Surplus Property Owned by the Village of Lake Zurich ORD. #2017-11-222

Summary: Staff has determined the items listed in this proposed Ordinance are no longer necessary, useful, or in the best interests of the Village to retain ownership. The proposed Ordinance declares the property as surplus and authorizes the sale or disposal of the items.

E. Annual Schedule of Meetings for 2018

Summary: Each year the Village Board approves the annual schedule of meetings for the following calendar year. Upon approval, the schedule for Lake Zurich commission and advisory boards will be published accordingly to fulfill the State of Illinois Open Meetings Act requirement.

Recommended Action: Motion was made by Trustee Euker, seconded by Trustee Spacone, to approve the Consent Agenda as presented.

Nays: 0

Absent: 1 Trustee Sprawka.

9. New Business

A.2017 Property Tax Levy Extension Ordinance and Six Abatement Ordinances Regarding Debt Service

Summary: Each year the Village approves a tax levy ordinance in order to have the Lake County Clerk extend property taxes on real estate parcels within Lake Zurich boundaries. The 2017 levy request is based upon the estimated equalized assessed value (EAV) of those properties. Applying the rates allowed by the Property Tax Extension Limitation Law (PTELL), the Village is requesting a total levy of $9,366,105, which represents an increase of 3.17% over the previous year. The largest components of this tax levy include $3,333,696 for police and fire protection services, another $3,964,251 for public safety pension obligations and $1,658,886 for debt service.

Six ordinances totaling $2,522,160 regarding debt service abatements are also presented for Village Board consideration. As sufficient funds are available from other revenue sources to pay scheduled debt service payments as they become due, the need to extend a property tax levy on these issues is not warranted. Therefore, the Village will notify the County Clerk to not extend property taxes on these abatement ordinances.

Recommended Action #1: A Motion was made by Trustee Beaudoin, seconded by Trustee Shaw, to approve Ordinance #2017-11-223 for the Annual Property Tax Levy Extension of $9,366,105.

Recommended Action #2: A motion was made by Trustee Beaudoin, seconded by Trustee Euker, to approve the following six abatement ordinances regarding debt service:

1. Ordinance Abating Certain Taxes Levied for $7,830,000 Taxable General Obligation Funding Bonds, Alternate Revenue Source, Series 2009A ORD #2017-11-224

2. Ordinance Abating Certain Taxes Levied for $3,800,000 General Obligation Bonds, Waterworks, and Sewerage System. Alternate Revenue Source, Series 2013AORD. #2017-11-225

3. Ordinance Abating Certain Taxes Levied for $6,325,000 General Obligation Refunding Bonds, Series 2014AORD. #2017-11-226

4. Ordinance Abating Certain Taxes Levied for $11,775,000 General Obligation Refunding Bonds, Series 2015AORD. #2017-11-227

5. Ordinance Abating Certain Taxes Levied for $7,100,000 General Obligation Refunding Bonds, Series 2016A ORD. #2017-11-228

B. Ordinance Approving Budget Amendment #2 for Fiscal Year 2017 Budget ORD. i2017-11-230

Summary: Upon evaluation of the financial projections for the current 2017 fiscal year, a number of necessary budget amendments have been identified based on actual figures or best estimates for projected year-end results. The largest adjustment to General Fund revenues is a reduction to Income Tax revenues by $167,000. However, overall the budget for the General Fund has a net positive impact to fund balance of $49,000 with this amendment. Additional savings are anticipated relating to full-time salaries due to vacancies. A listing of all proposed amendments to several different municipal funds has been included in the proposed Ordinance, including the Hotel/Motel Fund, Special Events Fund, Capital Improvement Fund, Water/Sewer Fund, and Tax Increment Financing Funds. Recommended Action: A motion was made by Trustee Beaudoin, seconded by Trustee Spacone, to approve Ordinance #2017-11230 approving budget amendment #2 for Fiscal Year 2017 Budget.

Nays: 0

10. Trustee Reports

Trustee Shaw mentioned the many improvement projects on businesses in Lake Zurich. Trustee Weider thanked the staff for their hardwork on the recent Budget Workshop.

11. Village Manager's Report

A.Monthly Data Metric Reports

Village Manager Ray Keller wished everyone a Happy Thanksgiving and requested an Executive Session for the purpose of 5ILCS 120/2(c)(11), pending or imminent litigation.

12. Attorney's Report

No report.

13. Department Head Reports

Police Chief Husak stated that donations can be made at the Movember fundraiser on the LZPD website.
