State Sen. Julie Morrison has filed a bill thaThe amendment to the criminal code of 2012 was filed in mid-October.
“A person commits aggravated assault when, in committing an assault, he or she knows the individual assaulted to be a judge of election: (i) performing his or her official duties; (ii) assaulted to prevent performance of his or her official duties; or (iii) assaulted in retaliation for performing his or her official duties,” the bill reads, and adds that this would result in a Class 4 felony.
A Class 4 felony calls for a 1- to 3-year prison sentence.
There is also a part of the bill that includes a penalty of a Class 3 felony.
“A person commits aggravated battery when, in committing a battery, other than by discharge of a firearm, he or she knows the individual battered to be a judge of election: (i) performing his or her official duties; (ii) battered to prevent performance of his or her official duties; or (iii) battered in retaliation for performing his or her official duties,” the bill states.
A Class 3 felony carries 5- to 10-year sentences.
