Public Hearing ‐ PZC‐01‐2018 ‐ 196 Knightsbridge Drive

This petition was withdrawn by the Petitioner

Public Meeting – PZC‐04‐2018 – Maple Hill Plat Revision

It was brought to Staff’s attention that Lots 33 and 44 in the Maple Hill First Resubdivision Plat were mistakenly platted narrower than intended. K. Hovnanian Homes wishes to record a Certificate of Correction to correct the two lots. One of the lots, Lot 33, is under the required 50’ lot width required by the Zoning Ordinance, which the revision corrects. Lots 66 and 43 will also need to be amended to accommodate the increased width.

Motion by K. Garesche, seconded by K. Anderson to recommend approval of a Plat Revision to the Maple Hill First Resubdivision.

Public Hearing – PZC‐02‐2018 – 339 East Maple Avenue

Motion by K. Garesche, seconded by S. Schneckloth to open Public Hearing PZC‐02‐2018 for 339 East Maple Avenue, Mundelein, Illinois.

Swear in Petitioners John Taylor (Project Manager/Property Owner) stated that he, and Mr. & Mrs. Bitto were business partners and he is the project manager.

Andy Bitto (Property Owner) stated that in order for the utilities to be separated and billed separately there needed to be two (PIN) Parcel Index Numbers.

Kate Bitto (Property Owner) stated that the property was purchased almost a year ago. The structure has been built to multi‐family dwelling specifications and in order to make a return on their investment they need to sell the property to two buyers, not one.

Public Comment

Mr. Vance Mellon (337 E Maple Avenue) stated his concerns regarding:

• The access easement agreement involving his driveway.

• The structure size.

• Will this affect his home values?

• Number of vehicles that will be parked.

• Will the construction and topography changes create a drainage issue? There is a very old garage on his property and he worries about flooding.

• Feels there should be an additional drain added at Route 176. If they redo the road, that should be addressed.

• Will utilities pass through his property and be an issue?

Mr. Dan Santeler (342 East Park Street, Mundelein) stated his property was previously zoned single family or multi‐family duplex and asked if the zoning had changed in the last ten years. He stated that the requested zoning relief for the Petitioner should be applied to all properties in the zoning district.

Closed Floor to Public Comment

Commission Discussion/Comments/Questions

There was discussion regarding other lots in the area with single‐family attached dwelling units on them; their size, and ownership. It was determined these properties have one owner, one (Parcel Index Number) and are addressed as one address with either unit A or B.

The Commissioners asked for clarification on the utility issue. The Petitioners stated that the utilities could not be separated unless each unit had its own PIN.

The Commissioners also discussed whether or not subdividing the lot was the only way for the Petitioners to be achieve their goal of having two PIN numbers for a single‐family attached dwelling.

Through discussion Mr. Mellon’s concerns were addressed and the newly built structure or subdividing of the lot would not impact his easement agreement or drainage.

The Commissioners did discuss tabling this agenda item until the Petitioners could provide additional materials to substantiate their hardships, allowing them to gather more information and provide more evidence; however, the Petitioners asked for an immediate vote. A lengthy discussion ensued.

Motion by K. Garesche, seconded by K. Anderson to recommend approval of a use variation from Section 20.28.020, Table 20.28‐1 to permit single‐family attached dwelling units in the R‐4 Two‐Family Zoning District.
