Cary Board of Zoning, Planning & Appeals approves installation of accessory solar energy system at daycare facility

Cary Board of Zoning, Planning & Appeals met Thursday, Feb. 23.

The Cary Board of Zoning, Planning and Appeals makes recommendations to the village board on land use issues pertaining to the village's Zoning Ordinance, including proposed variations, text amendments, map amendments, conditional use permits and appeals of decisions made by the Zoning Administrator. The board meets at 7:30 p.m. on the second and fourth Thursday of the month.

MINUTES OF THE REGULAR MEETING OF THE BOARD OF ZONING, PLANNING AND APPEALS

Chairman Khoury called the meeting to order at 7:30 PM. Chairman Khoury entertained a general consent motion to approve the minutes of January 26, 2017. The minutes were approved 5-0. Chairman Khoury called Village Case No. 17-ZPA-02-002 to order.

Director Simmons stated the petitioner is requesting a continuation to March 9, 2017. The public notice was published one day after the deadline.

Chairman Khoury entertained a motion to approve the continuation of Village Case No. 17-ZPA-02-002 to March 9, 2017.

Member O'Laughlin moved, seconded by Member Williams, to approve the continuation of Village Case No. I 7-ZPA-02-002 to March 9, 2017.

Chairman Khoury called the meeting to order at 7:30 PM. Chairman Khoury entertained a general consent motion to approve the minutes of January 26, 2017. The minutes were approved 5-0. After reviewing two previous cases, Chairman Khoury called Village Case No. 17-ZPA-02-001 to order.

Director Simmons stated the petitioner is seeking to expand their existing facility located at 3909 Three Oaks Road in the Village. The Petitioner is seeking approval to rezone the subject property from B-2 Shopping Center Business District to B-P Business Park District similar to the approvals granted to the adjoining 27-acre parcel, detention basin, and former right-of-way for Sage Parkway in November 2016.

The subject property was not part of the November 2016 map amendment request as the Petitioner did not have ownership or a contract to purchase the 0.964 acre parcel at that time. Following the recent map amendment approvals, the Petitioner has subsequently purchased the subject property and is seeking to rezone the parcel to be consistent with the remainder of property owned by the Petitioner.

The Petitioner has submitted building permit applications for the first phase of the expansion construction, a warehouse expansion of approximately two hundred thousand square feet on the south portion of the property.

Mark Saladin, attorney for the Petitioner presented a brief overview of the petition and indicated he would be willing to answer any questions related to the project.

Chairman Khoury closed the public portion of the meeting.

Chairman Khoury entertained a motion to recommend to the Village Board of Trustees approval of a map amendment to rezone the vacant property located to the southwest of the Intersection of Three Oaks Road and Georgetown Drive, identified as PIN 19-11-403-001 from B-2 Shopping Center Business District to B-P Business Park District.

Member O'Laughlin moved, seconded by Member Kretschmer, to recommend to the Village Board of Trustees, approval of map amendment to rezone the vacant property located to the southwest of the Intersection of Three Oaks Road and Georgetown Drive, identified as PIN 19-11-403-001 from B-2 Shopping Center Business District to B-P Business Park District.

Voting Aye: Khoury, Kretschmer, Jasper, Williams, O'Laughlin Abstain: None Voting Nay: None

Chairman Khoury called the meeting to order at 7:30 PM. Chairman Khoury entertained a general consent motion to approve the minutes of January 26, 2017. The minutes were approved 5-0. After reviewing three previous cases, Chairman Khoury called Village Case No. 17-ZPA-02-004 to order.

Director Simmons stated the petitioner is seeking to approval of a conditional use in order to construct an accessory solar energy collection system to the Kids R Kids daycare facility currently under construction at 2250 Crystal Lake Road. As proposed, one hundred twenty-eight (128) solar photovoltaic panels will be installed on the roof on either side of the structure. Per the Village’s Zoning Ordinance, accessory solar energy systems require conditional use approval within the R-1 Low Density Single-Family Residential District.

The subject property is located on the north side of Crystal Lake Road approximately 200 feet east of its intersection with Wood Drive. The subject property is zoned R-1 Low Density Single-Family Residential District and is bordered by the E-1 district to the South, the R-1 district to the east and north, and unincorporated McHenry county residential to the west. The Kids R Kids daycare received zoning entitlements in February 2015. Permits to construct the facility were issued in late 2016 with the facility currently being under

construction.

The Petitioner, Mr. Yunsik Lee, was present and indicated he would be willing to answer any questions related to the project.

Chairman Khoury closed the public portion of the meeting.

Chairman Khoury entertained a motion to recommend to the Village Board of Trustees approval of a conditional use for an accessory solar energy system for the property located at 2250 Crystal Lake Road subject to the following conditions:

1. The conditional use shall be granted for the property located at 2250 Crystal Lake Road. The proposed improvements shall substantially conform to the attached plans and exhibits as part of this petition, except as they may be changed to conform to Village Codes and all conditions of approval.

Member O'Laughlin moved, seconded by Member Kretschmer, to recommend to the Village Board of Trustees, approval of conditional use for an accessory solar energy system for the property located at 2250 Crystal Lake Road subject to the following conditions:

I. The conditional use shall be granted for the property located at 2250 Crystal Lake Koad.

2. The proposed improvements shall substantially conform to the attached plans

and exhibits as part of this petition, except as they may be changed to conform to Village Codes and all conditions of approval.

Voting Aye: Khoury, Kretschner, Jasper, Williams, O'Laughlin Abstain: None Voting Nay: None

Motion Passed; 5-0

Chairman Khoury entertained a motion to adjourn at 7:53 pm. Member O'Laughlin moved, seconded by Member Williams and the meeting was adjourned at 7:53 pm.
