The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.
In essence, the bill, titled the Wellness and Oversight for Psychological Resources Act, aims to protect individuals seeking therapy or psychotherapy services by ensuring these services are delivered by qualified, licensed, or certified professionals. It prohibits unauthorized individuals or entities from offering these services or using artificial intelligence (AI) for therapeutic purposes unless specific conditions are met, including informed consent. Licensed professionals may utilize AI for administrative or supplementary support but must retain full responsibility for the AI’s output. The bill enforces confidentiality of patient records and mandates penalties, up to $10,000 per violation, for those infringing on these regulations. It excludes religious counseling, peer support, and self-help materials not claiming to offer therapy services. The act takes effect immediately upon becoming law.

Bills in Illinois follow a multi-step legislative process, beginning with introduction in either the House or Senate, followed by committee review, floor debates, and votes in both chambers before reaching the governor for approval or veto. The General Assembly operates on a biennial schedule, and while typically thousands of bills are introduced each session, only a fraction successfully pass through the process to become law.
