Village of Cary Village Board of Trustees met February 19

Village of Cary Village Board of Trustees met Feb. 19.

Here is the minutes provided by the board:

Call to Order This meeting was called to order at 6:00 p.m. by Mayor Kownick.

Roll Call Present: Mayor Kownick and Trustees Kraus, Covelli, Cosler, Betz, McAlpine and Weinhammer Absent: None

Others present included Village Administrator Rife, Police Chief Finlon, Public Works Director Morimoto, Finance Director DuCharme, Management Analyst Sage, Village Attorney Forte and members of the audience per the sign-in sheet.

III. Pledge of Allegiance Mayor Kownick led in the recitation of the Pledge of Allegiance.

IV. Open Forum Linda Stelle, 269 Stonegate Road, stated she was concerned about future preservation of the current Village Hall due to the proposed zoning changes within the UDO.

There being no further comments from the public, Mayor Kownick closed Open Forum at 6:03 p.m.

V. Mayor's Report

1. Mayor Kownick recognized Cary Fire Protection District Chief Jeff Macko on his retirement.

VI. Trustee Reports Trustee McAlpine attended the Mayor's Roundtable presentation hosted by the Chamber of Commerce and commended Director Simmons and other staff for their work on the presentation.

VII. Consent Agenda

1. Consider for Approval the Warrant Dated February 19, 2019 2. Consider for Approval an Ordinance Amending Title 9.34.070 of the Village's Cemetery Fees 3. Consider for Approval a Resolution Regarding Permits for the Construction of Improvements or Repairs Along State Highways by the Village of Cary

Motion: Trustee McAlpine moved, seconded by Trustee Kraus, to approve Consent Agenda Items #1 - #3.

Ayes: Cosler, Weinhammer, McAlpine, Betz, Covelli, Kraus 

Nays: None 

Abstain: None

Motion Carried

VIII. Items for Separate Action 1. Consider for Approval a Resolution Authorizing the Village Administrator to Purchase Provisional

Bulk Road Salt in an Amount Not to Exceed $51,000.00

Motion:

Trustee Covelli moved, seconded by Trustee McAlpine to approve a resolution authorizing the Village Administrator to purchase provisional bulk road salt in an amount not to exceed $51,000.00.

Discussion Director Morimoto provided an overview of the proposed provisional bulk road salt purchase through a municipal purchasing association.

Ayes: McAlpine, Betz, Covelli, Kraus, Cosler, Weinhammer Nays: None Abstain: None

Motion Carried

2. Consider for Approval a Resolution Approving the Village of Cary Social Media Policies

Motion:

Trustee McAlpine moved, seconded by Trustee Betz to approve a resolution approving the Village of Cary social media policies.

Discussion Administrator Rife provided an overview of the proposed social media policy with the amended Exhibit C, “Use of Village Social Media Accounts by Village Staff and Elected Officials." The suggested amendment strikes the words "and other social media sites" from Section C, Item #3.

Trustee Covelli supports the amended Exhibit C and would like to remove 'elected officials' from Section D, Item #6.

Trustee Cosler supports the amended Exhibit C and would like to remove 'elected officials' from Section D, Item #6. Trustee Cosler also stated he supported removing all references to 'elected officials' from Exhibit C.

Administrator Rife stated removing references to elected officials could create complications with the Open Meetings Act should multiple elected officials comment on an item on the Village's Facebook page.

Attorney Forte stated elected officials may unintentionally violate the Open Meetings Act by posting comments, unaware that other officials posted comments. Additionally, since social media posts are subject to the Local Records Act, comments are required to be maintained even if they are later deleted.

Mayor Kownick motioned to amend the proposed resolution regarding the Village of Cary's social media policies to include the proposed changes to Exhibit C, Section C, Item #3 and Section D, Item #6.

Ayes: Covelli, McAlpine, Betz, Kraus, Weinhammer 

Nays: Cosler 

Abstain: None

Motion Carried

Mayor Kownick moved to approve a resolution approving the Village of Cary social media policies with the proposed amendments to Exhibit C, Section C, Item #3 and Section D, Item #6.

Ayes: Covelli, McAlpine, Betz, Kraus, Weinhammer Nays: Cosler Abstain: None

Motion Carried

3. Consider for Approval Minutes of the February 5, 2019 Village Board Meeting

Motion:

Trustee Covelli moved, seconded by Trustee McAlpine to approve the Minutes of the February 5, 2019 Village Board Meeting.

Discussion None.

Ayes: McAlpine, Betz, Covelli, Kraus, Cosler Nays: None Abstain: Weinhammer

Motion Carried

4. Consider for Approval an Ordinance Accepting a Warranty Deed for the Transfer of Property from

Lafarge Aggregates/Meyer Material to the Village of Cary (Continued to March 5, 2019)

Administrator's Report Administrator Rife stated the Village Budget Workshop will take place on Saturday, March 16th at 9:00 a.m. Residents are welcome to attend.

IX. Department Head Reports None.

XI. Future Agenda Items and Discussion by Village Board None.

XII. Adjourn

There being no further items to discuss, a MOTION was made to adjourn the meeting at 6:26 p.m.

SECOND: Trustee Kraus

The Voice Vote noted all ayes and the motion carried.
