EXECUTIVE SESSION MINUTES

The City Council met in Executive Session on Tuesday, February 16, 2016 at 7:59 p.m., in the Conference Room,

100 N. Martin Luther King Jr. Ave., Waukegan, Illinois, to discuss pending litigation.

ROLL CALL: Aldermen Seger, Moisio, Villalobos, Newsome, TenPas, Valko, and Taylor

Mayor Motley stated that they have worked on this project for the past 15 year. The issue has been resolved. We

went to court with them and mediated the case ourselves. Steve, I, and Larsen Marine came to an agreement. The

judge signed the order which contained the settlement terms. Steve Martin stated that on September 22, 2006, they

entered into a settlement agreement. Relative to slip three on the map, what we agreed to do was recondition,

remediate slip three because it was dirty so that Larsen could build a storage building. At the point and time the

City’s cost started at about $400,000.00 and over time when the City did not take any action, to about $2,500,000.00

we also agreed to give them some land. They would receive a strip of land approximately 30 ft. by 650 ft. directly

south of Larsen’s current property. If we didn’t do what we agreed to do in the order, Larsen was to receive a 99

year lease for a parcel directly east of its current property as well as a 99 year lease for an approximate 4 acre parcel

north of Sea Horse Drive. This property north of Sea Horse Drive this is in the middle of the OMC redevelopment

area. It would make it difficult for a developer to come in and use this property. This is the mess we started with

when we got here. The moving party in this was the Mayor. He personally started working with Jerry Larsen or else

nothing would have gotten done. We don’t have two million dollars nor is it our intent to spend two million dollars.

Therefore, we agreed to give Larsen Marine an additional 70 feet more to the south as well as an additional 70 feet

to the east. We get back 4.4 acres to the north of Sea Horse Drive making the OMC property more favorable for

development. They wanted the deal plus $405,000 dollars. The mayor said that is not going to happen. The only

monies we will spend are closing costs and surveys in the amount of $1,600.00.
