6. Public Input – Items Not On Agenda

Lenny Innocenzi, Buffo’s: Mr. Innocenzi spoke on the upcoming Starving Artist Show scheduled for

Saturday and Sunday, September 24th and 25th. The notice from the presenters of the Art Show was

mailed out 14 days prior to the event, with an error of Walker Avenue being the ending street instead

of the Webster Avenue being the actual ending street. Mr. Innocenzi questioned why not on Green

Bay Road, rather than Sheridan Road on a regular basis, as in two weeks, Sheridan Road will be closed

again for the Pumpkin Festival.

Jagger Davis: stated wooden telephone poles are dipped in PCP, which is a dangerous odorless

chemical which radiates 20 feet.

Lynette Perkins: Suggested the Art Fairs and other activities be held in the Metra Train lot in lieu of one

of the streets in front of the businesses in town.

7. Mayor’s Report

7.1. Presentation by ComEd on their Upcoming Smart Meter Program – Darren Boundy

Darren Boundy, External Controls and Dave Doherty, Meter Deployment presented their upcoming

smart meter program. This is the 3rd year for the smart meter program. There are 1024 meters to replace

in Highwood and their representatives will be in marked cars plus have a photo ID. They explained with

the radio inside the meter, it improves the reliability, keeps rates low, and would generally take ½ hour

or less to change out. There is an opt-out program, where the customer would be charged an

additional $21.53 per month for the customers who refuse the smart meters. This presentation is for

notification only as the installation for Highwood will begin in November 2016.

Resolution Approving and Accepting an ARC Recommendation for 317 Waukegan

Avenue (Commercial Door). All present voting aye, by voice vote, motion carried.

12.2. 16-O-42 Moved by Alderman Falberg, seconded by Alderman Grice to waive the first

reading and approve an Ordinance Authorizing a Redevelopment Agreement Between

the City of Highwood and Highwood Property Investors, LLC for the Property at 546 Green

Bay Road, Comprising a Part of the Downtown TIF Redevelopment Project Area of the City

of Highwood, Lake County, Illinois. All present voting aye, motion carried.

It was noted there are 28 units in this building proposal.

12.3. Moved by Alderman Falberg, seconded by Alderman Slavin to authorize Motion

Authorizing the City Manager to Execute a First Amendment to the City of Highwood Snow

Removal and Salt Application Agreement. All present voting aye, motion carried.

The City will continue to plow the sidewalks, but will contract out the rest of the plowing.

Two old refrigerators are going from the Recreation Center to the Bocce Ball Club.

Moved by Alderman Slavin, seconded by Alderman Feddermann to go into executive session to

discuss 2C1, 2C5, and 2C21. All present voting aye, motion carried.

Prior to the vote to go into executive session, 3 persons from the Public chose to speak regarding the

smart meters.

Lynette Perkins: spoke of the opt-out option for the Commonwealth Edison Smart Meter Program.

Jagger Davis: spoke again of the dangers of the chemicals used by Commonwealth Edison.

Nancy J. Thorner: questioned whether Highwood administrators were going to allow the ComEd to

place the smart meters on all the homes and businesses warning of the adverse effects on Highwood

residents. She provided a booklet of information to the Mayor, City Manager, and Police Chief.

13. Moved by Alderman Slavin, seconded by Alderman Feddermann to reconvene the Regular City

Council Meeting. Any Action Necessary Coming Out of Executive Session will be sealed until no

longer sensitive. All present voting aye, by voice vote, motion carried. Mayor Pecaro reconvened

the meeting at 8:42 P.M.

City Manager pointed out the final payments for the capital improvements. Other payments were

discussed, but all payment on the warrant list are approved to be paid.

7.1. Consideration of a Resolution Approving and Accepting an ARC Recommendation for

317 Waukegan Avenue (Commercial Door).

The pictures were reviewed of the door, and the resolution will be approved at the Regular City Council

Meeting.

7.2. Consideration of an Ordinance Authorizing a Redevelopment Agreement Between the

City of Highwood and Highwood Property Investors, LLC for the Property at 546 Green

Bay Road, Comprising a Part of the Downtown TIF Redevelopment Project Area of the

City of Highwood, Lake County, Illinois.

It is proposed the City would vacate and provide the parking along Washington and up to 10 spots of

Green Bay Road with a charge of $90.00 per quarter per spot at the beginning of the quarter. The

parking on Green Bay Road south of Washington would be sub-leased of our lease of the 10 spots from

the rail road at a rate of $1.00/day/spot. Discussion ensued. Alderman Feddermann expressed

concern over the parking issues as the developer is allowing for 1.3 cars per unit. Alderman Grice stated

the original building materials were questionable, but by the second meeting they met the

requirements for building materials. The single units will be 700 square feet, at a cost of $1350.00 per

month. There will be different options. Alderman Slavin stated a need for the developers to do their

own signage for the 10 spots, residential parking only, and that the City will add the signage

responsibility to the developers and will monitor.

7.3. Discussion on the Fire Services Provided by Highland Park Fire Department.

Deputy Chief Larry Amidei thanked the City of Highwood office staff for their assistance. 60 of the alarm

issues have be resolved. ¾ of all alarms within the Highwood City limits have been inspected. Highland

Park Fire Department participated in the fire drill at Oak Terrace School last week. There has been an

extra AED donated to the Nuestro Center. On September 9, 2016, the Fire Department, Highwood

Police Department and Ft. Sheridan participated in an active shooter drill. The Fire Department plans

to have an ambulance present at the Pumpkin Festival. The response times are 3-4 minutes west of the

tracks, and 4-6 minutes east of the tracks.

7.4. Discussion on the Property at Prairie Avenue and Burtis Avenue.

Debbie Beaver, a purchaser of the Fiore property of on the corner of Burtis and Prairie Avenues

presented their proposal of a 7 unit townhome project. The Council, as a whole was not in favor the 7

units, siting the density issues. The Council would possibly reconsider if it were a 5-6 unit proposal. Debbie

stated she would need to go back to the Fiore’s to renegotiate the purchase price. Walnut Creek was

the example of the type of housing for the corner. The starting costs of the units would be $450,000.00.

7.5. Consideration of a Motion Authorizing the City Manager to Execute a First Amendment

to the City of Highwood Snow Removal and Salt Application Agreement.

It is prosed to expand the contracting of the snowplowing to all streets and parking lots. The cost would

be $100,000.00 which would come out of MFT fund. The City would continue to plow the sidewalks.

7.6. Consideration of a Motion Agreeing to an Amended Fee Structure for Klein, Thorpe &

Jenkins Legal Fees.

The increase would be 2.5% increase.

7.7. A Discussion on the City Property Located Between Union Pacific Railroad Property and

the National Park Property.

Dr. Kordell, of the veterinarian clinic on Sheridan Road suggested some improvements to the National

Park Issue, including trees if his parking lot area could be expanded. Parcel #1 belongs to the City. (see

exhibit) It was decided Dr. Kordell would work with City Manager Coren as well as Scopelliti and Mariani

for the landscaping.

7.8. A Discussion on Proposals Submitted for the Fire Station Property.

There were 2 proposals submitted, one being the recreation department, the other the performer’s

school which is currently rents from the recreation department. It was decided by the Council to extend

the RFP, as the Council wants the property back on the tax roles. IT is estimated to bring in $20-25,000.00

per year of property tax income. Ivan Tosi thought the recreation center could rent out the space

bringing in $5,000-$8,000.00 per month. However, improvements would be required prior to renting the

space.

7.9. A Discussion on Implementing a Formal Sidewalk Replacement Program.

Council was in favor of the sidewalk program, and for next year too, estimating $20-30,000 range for

the next couple of years.

7.10. Consideration of an Ordinance Authorizing the Disposal of Surplus Property Owned by

the City of Highwood.

Refrigerators from the recreation department to the Bocce Club.

7.11. A Discussion on the Placement of Two Sculpture Donations from the Julia Foundation.

7.12. A Discussion on the Special Events Application for the 2016 Highwood Pumpkin Festival.

The Pumpkin Festival is scheduled for October 7th – 9th, with the carnival starting on October 6th. Notices

to the businesses are expected by Friday, September 23, 2016.

A RESOLUTION APPROVING AND ACCEPTING AN ARC RECOMMENDATION

REGARDING A WALL SIGN AT 254 GREEN BAY ROAD FOR GINGER’S

WHEREAS, In accordance with Title 10 Chapter 3 of the Highwood City Code, an application

has been submitted to the City of Highwood Appearance Review Committee ("ARC") for a proposed wall

sign at 254 Green Bay Road, Ginger’s; and

WHEREAS, The ARC has determined that the proposed curbside wall sign is appropriate and

therefore recommended for approval by the City Council; and

WHEREAS, The City Council of the City of Highwood accepts the ARC recommendation and

desires to approve the wall sign as proposed.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

Dear ARC Committee:

This application contemplates the installation of a 72" wide x 18" high sign over the

front door that simply states, "Ginger's". This sign is intended to advertise our

business name to the community while keeping the overall design in accordance

with the existing Irish Pub fac;:ade. This sign fits exactly in the recess above the door

which is also 72"x18". The letters will be approximately 12" high and are in an

Irish-ish font, as depicted in the attached documents.

The sign will be made out of "MaxMetal" which is a plastic sheet, laminated in

aluminum, with a baked enamel finish. No additional lights will be installed. The

sign will be attached to the wood by 6 black screws to achieve a seamless

integration.

Action Items

1) The ARC recommends Council approval of the window logo and door

signage for Marco's Northside Grill 329 Waukegan Avenue, per the photos

and drawings submitted.

The Committee recommendation was unanimous.

The ARC recommends Council denial of the color of the proposed awning.

While the ARC understands and appreciates the applicant's color request

as part of the business brand, the Committee finds the color inconsistent

with other awning colors in the business district and suggests a more

subdued blue shade, citing Code 10-3-6-7: ...the color of

corporate logos may be required to be changed or subdued to meet the

intent and purpose of the code.

The Committee recommendation was divided evenly (2 yeas, 2 nays).

2) The ARC recommends Council approval of the proposed wall, window and

door signage for IC Signs and Graphics, 417 Sheridan Road, per the

photos, drawings and samples submitted.

Wall sign: The applicant's request for a neon lit hawk head figure was

rejected by the Committee, in favor of an LED lit figure, citing Code

10-3-6-7: G.6: Neon signs not specifically permitted herein are prohibited.

The Committee rejected the applicant's original two tone awning color

request, citing Code 10-3-6-7: ...the color of corporate logos may be

required to be changed or subdued to meet the intent and purpose of the

code. The Committee suggested, and applicant agreed, to a single color of

R772, Blue Tweed, for both the awning face and apron, with white apron

lettering.

The ARC recommends Council approval of the revised awning/apron color and

lettering proposal.

All numbers, lettering and icons on the door and on the window design

appliques shall be a maximum 4" (four) inches in height.

Social Media icons: The ARC recommends a variance to Code 10-3-6-7

G15: Other signs not permitted by this chapter shall be prohibited. based

on variance 10-3-9: A. 1. a. (3) ...this proposed sign...is consistent with the

overall purpose of this chapter.

The Committee recommendations were unanimous.

3) The ARC recommends Council approval of the wall signage for Ginger's,

254 Green Bay Road, per photo and drawings submitted.

AT 417 SHERIDAN ROAD FOR IC SIGNS AND GRAPHICS

BE IT ORDAINED by the City Council of the City of Highwood, Lake County, Illinois, as follows:

SECTION 1: All numbers, lettering and icons on the door and on the window design appliques shall

be a maximum 4" (four) inches in height. Social Media icons: The ARC recommends a variance to Code

10-3-6-7 G15: Other signs not permitted by this chapter shall be prohibited…based on variance 10-3-9: A.

1. a. (3) ...this proposed sign...is consistent with the overall purpose of this chapter. In accordance with

the recommendation made by the ARC attached hereto as Exhibit A and the proposal attached hereto as

Exhibit B.

SECTION 2: The City Council further accepts the recommendation made by the ARC attached hereto

as Exhibit A and hereby approves the application for the awning and sign package as depicted in the

proposal attached hereto as Exhibit B.

SECTION 3: Except as provided herein, Applicant shall comply with all other applicable provisions of

the City of Highwood Appearance Code.

SECTION 4: This ordinance shall be in full force and effect from and after its adoption and publication

in pamphlet form as provided by law.

SECTION 5: Any and all ordinances, sections or subsections of ordinances in conflict herewith are

hereby repealed.

SECTION 6: In the event any part or parts of this Ordinance shall be found to be unconstitutional by a

court of competent jurisdiction, such unconstitutionality shall not affect the validity of the remaining parts

of this Ordinance.

required to be changed or subdued to meet the intent and purpose of the

code. The Committee suggested, and applicant agreed, to a single color of

R772, Blue Tweed, for both the awning face and apron, with white apron

lettering.

The ARC recommends Council approval of the revised awning/apron color and

lettering proposal.

ISSUE STATEMENT

An ordinance amending 4-1-7: Classification of Licenses in the Highwood City Code to add a

Class A liquor license for Marco’s Northside Grill.

BACKGROUND/HISTORY

The City of Highwood has received an application from a business to occupy the site that was

previously Tres Hermanas. The restaurant and bar will be called Marco’s Northside Grill. To

open, the establishment needs to be issued a Class A liquor license, which is for bars and

restaurants. Since all available Class A liquor licenses have been issued, this ordinance increases

the number of total licenses available from 18 to 19.

STAFF/COMMITTEE RECOMMENDATION

Staff recommends approval of this ordinance.

ALTERNATE CONSIDERATION

Not approving the ordinance would be an alternate consideration.

AN ORDINANCE AMENDING 4-1-7: CLASSIFICATION OF LICENSES

IN THE HIGHWOOD CITY CODE TO ADD A CLASS A LIQUOR

LICENSE – MARCO’S NORTHSIDE GRILL

WHEREAS, the City of Highwood is a home rule unit of government under Section

6(a); Article VII of the 1970 Constitution of the State of Illinois, and may exercise powers

pertaining to its local governmental affairs; and

WHEREAS, the City of Highwood has received a request for a Class A license to serve

beer, wine and spirits at Marco’s Northside Grill,

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE

CITY OF HIGHWOOD, LAKE COUNTY, ILLINOIS, as follows:

SECTION 1: Section 4-1-7: Classification of Licenses of the Highwood City Code is

hereby amended to provide as follows [deleted language stricken]:

4-1-7: CLASSIFICATION OF LICENSES:

A. Class A License: Restaurant or Bar Full License

1. License holder is authorized to sell beer, wine and spirits on premises only.

2. The number of licenses allowed shall be 18 19.

3. Alcohol sales may not be conducted between 1:00 AM and 5:00 AM Monday through

Thursday, or 3:00 AM and 5:00 AM Friday through Sunday, New Year’s Day,

Thanksgiving and the day after St. Patrick’s Day.

4. The initial fee for a Class A license shall be $10,000. The annual fee for a Class A

license shall be $3,160.

SECTION 2: This ordinance shall be in full force and effect from and after its adoption

and publication in pamphlet form (which publication is hereby authorized) as provided by law.

BACKGROUND/HISTORY

Ivan Tosi, the Director of Parks & Recreation approached the City Manager about the current

hourly rental rates for the recreation center and the Western Avenue ballpark. Over the past few

years there has been extremely strong demand for these facilities and the rental rates currently

charged are advantageous to many partnering agencies that rent out space. He recommended

increasing the rates of two specific services: birthday parties or events and ballpark practice

rentals. He does not anticipate losing any partnering agencies due to this increase. The

additional revenue generated can help keep pace with the cost of maintaining these facilities and

for improving parks and recreational facilities in Highwood.

Staff recommends approval.

ISSUE STATEMENT

An ordinance amending 10-3-6-7 D 2 d (1) of the Appearance Code: Window Signs in the

Highwood City Code to restrict the number of social media logos allowed on window signs.

BACKGROUND/HISTORY

At the September 27, 2016 meeting of the Appearance Review Committee the Committee asked

Staff to bring forward to the City Council and ordinance restricting the number of social media

logos allowed on window signs. As social media has gained popularity some businesses may

want to communicate they can be found on Facebook, Twitter, Linked-In, Snapchat or other

locations. The Committee wanted to make sure the code was clear to applicants the allowance

for this was not unlimited.

Staff recommends approval of this ordinance.

WHEREAS, the City of Highwood is a home rule unit of government under Section

6(a); Article VII of the 1970 Constitution of the State of Illinois, and may exercise powers

pertaining to its local governmental affairs; and

WHEREAS, the City of Highwood has received a request from the Appearance Review

Committee to codify that only five social media logos be allowed on a window sign,

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE

CITY OF HIGHWOOD, LAKE COUNTY, ILLINOIS, as follows:

SECTION 1: Section 10-3-6-7 D 2: Permitted Information of the Highwood City Code

is hereby amended to provide as follows [deleted language stricken]:

10-3-6-7 D 2: Permitted Information

d. Notwithstanding any other provision of this chapter to the contrary, any window sign for

which a permit is sought may contain one telephone number and area code of the business

establishment; provided, that there is compliance with the following requirements:

(1) No more than one telephone number (including area code) and/or internet address and a

maximum of five social media icons may be allowed for each business establishment.

(2) The above shall be in letters, or numbers or icons not exceeding four inches (4") in

height.

SECTION 2: This ordinance shall be in full force and effect from and after its adoption

and publication in pamphlet form (which publication is hereby authorized) as provided by law.
