Joint resolution authorizing an agreement with Bloom Companies, LLC, Chicago, Illinois, at a cost of $48,010.94, for the provision of Phase II design engineering services to stabilize existing retaining walls on the east and west sides of Fairfield Road, north of Illinois Route 60, appropriating $60,000 of Matching Tax funds for these services.
· This project includes stabilizing existing retaining walls on the east and west sides of Fairfield Road, north of Illinois Route 60.
· A consultant will be utilized to provide Phase II design engineering services, including a geotechnical investigation and report which will be used during the design process.
· Lake County selects professional engineering firms in accordance with the Local Government Professional Services Selection Act, 50 ILCS 510/1 et. seq.
· The selected firm has a satisfactory past relationship with the Lake County Division of Transportation.
· The selected, and recommended, firm is Bloom Companies at a cost of $48,010.94.
· This project is included in the Transportation Improvement Program, and designated as Section 20-00145-05-GM.

Joint resolution authorizing an agreement with the State of Illinois/Illinois Department of Transportation (IDOT), for traffic signal improvements at the intersection of Illinois Route 131 and 14th Street/Casimir Pulaski Drive, and appropriating $20,000 of 1⁄4% Sales Tax for Transportation funds.
· The Illinois Department of Transportation (IDOT) will be modernizing the existing traffic signals at the intersection of Illinois Route 131 and 14th Street/Pulaski Drive.
· This improvement will include replacement of the traffic signal controller, cabinet, posts, and mast arms.
· IDOT has secured federal safety funds to pay up to 80 percent of the costs for the project.
· The County’s share of the project is for the improvements to 14th Street/Pulaski Drive and is estimated to be $16,675.
· This project is included in the Transportation Improvement Program with construction expected to begin in 2020, and designated as Section 20-00999-75 -TL.

Joint resolution appropriating $40,000 of 1⁄4% Sales Tax for Transportation funds for cellular service, landline phone service, and electrical service to communicate with various Lake County Division of Transportation (LCDOT) field assets, including traffic signals, cameras, pavement sensors, and snow and ice equipment and integration with Lake County PASSAGE.
· The Lake County Division of Transportation and Lake County’s PASSAGE system gathers data from traffic signals, counters, pavement sensors, cameras, and snowplows to manage traffic and provide the public with this information through various means to make an informed decision when traveling.
· This project is included in the Transportation Improvement Program, and designated as Section 21-00000-18-GM.
PUBLIC WORKS

Joint committee action approving 33103 N. Mill Road as excess property and authorizing the auction sale of the parcel.
· The County owns the property at 33103 N. Mill Road, Grayslake. This property was used by Public Works as a well site. The property previously contained one well, and underground pressure tank and a small well house which contained treatment equipment and controls.
· The wells have been abandoned, the well house has been demolished and the tank has been removed and property is currently vacant.
· The property is 0.23 acres (10,058.57 square feet) and is zoned Residential (R4).
· We have offered the property to the Division of Transportation for potential right-of-way or other uses related to N. Mill Road and they have no need for the parcel.
· If declared excess property, the parcel will be sold via auction. Two adjacent property owners have indicated interest in the property.

Joint resolution authorizing a contract with KLF Enterprises Inc., Markham, Illinois, in the amount of $21,647.50 for the demolition of a commercial structure on the Robert McClory Bike Path right-of-way, located north of Grand Avenue in Waukegan, Illinois, and appropriating $30,000 of 1⁄4% Sales Tax for Transportation funds.
· The existing commercial structure located on the Robert McClory Bike Path right-of-way is immediately adjacent to the bike path.
· After the structure is removed, the right-of-way will be returned to green space as part of a separate project that will be constructed in 2021. This project will enhance the experience of Robert McClory Bike Path users, improving safety, visibility, and aesthetics in the area north of Grand Avenue.
· A total of five bids were received, ranging from $21,647.50 to $97,250, and the lowest responsible bidder is KLF Enterprises Inc., in the amount of $21,647.50.
· This project is included in the Transportation Improvement Program with work planned to be completed in 2020, and designated as Section 20-00173-17-BD.

Joint resolution authorizing an agreement with BLA Inc., Itasca, Illinois, for Phase II design engineering services for the resurfacing of 33rd Street, Kenosha Road, and Russell Road, at a maximum cost of $254,640, and appropriating $305,000 of Motor Fuel Tax funds.
· These resurfacing improvements have been identified within the County’s pavement management system and are included in the Transportation Improvement Program.
· A consulting firm will be utilized to complete these engineering services.
· Lake County selects professional engineering firms in accordance with the Local Government Professional Services Selection Act, 50 ILCS 510/1 et. seq.
· The selected firm has a satisfactory past relationship with the Lake County Division of Transportation.
· The selected, and recommended, firm is BLA Inc., Itasca, Illinois, at a cost of $254,640.

Joint resolution authorizing an agreement with Parsons Transportation Group Inc., Schaumburg, Illinois, for three years of professional engineering services for the ITS PASSAGE System Integration 2020 at a maximum cost of $1,625,000, appropriating $1,950,000 of the 1⁄4% Sales Tax for Transportation funds.
· The System Integration work for Lake County PASSAGE will continue to enhance the current system, design and integrate field communication devices, maintain system components in the Traffic Management Center (TMC) and in the field, monitor traffic signal operations, and provide data collection and analysis.
· Lake County PASSAGE is currently connected to 638 traffic signals and 415 traffic monitoring cameras.
· A consultant will be utilized to undertake the System Integration work for Lake County PASSAGE.
· Lake County selects professional engineering firms in accordance with the Local Government Professional Services Selection Act, 50 ILCS 510/1 et. seq.
· The selected firm has a satisfactory past relationship with the Lake County Division of Transportation.
· The selected, and recommended, firm is Parsons Transportation Group Inc., with a maximum cost of $1,625,000 for a three-year contract term.
· This project is included in the Transportation Improvement Program, and designated as Section 20-00268-23-TL.

Joint resolution authorizing Modification Number One for Agreement Number 20021 with Donohue and Associates Inc., Sheboygan, Wisconsin, to provide final design services for the Supervisory Control and Data Acquisition system in the Southeast and former Lakes Region systems.
· Lake County Public Works operates a robust Supervisory Control and Data Acquisition (SCADA) system. The system allows for wireless communication and data collection among the various Lake County Public Works water and wastewater systems. This results in less drive time and fewer miles driven, benefiting the environment. The data repository is used to make data driven decisions on system functionality.
· In July 2020, the Lake County Board authorized a contract with Donohue and Associates Inc. for the initial phase of the Phase III SCADA agreement in the amount of $69,680.
· The initial agreement for preliminary engineering services was intended to be amended to include final engineering and system integration services in the future, which is consistent with the County’s experience in multi-phase professional contracts.
· This contract modification will provide final engineering design services for the remote sites that will be connected to the SCADA network in the amount of $82,595.
· The additional scope of work will include design of electrical panels, communication equipment and any additional time required to upgrade the control equipment of the remote sites.
· Contract Modification Number One increases the amount of Engineering Design Services contract by $82,595 from $69,680 to $152,275.
· In accordance with Article 8, Section 101 (1) of the Lake County Purchasing Ordinance it is hereby requested that the Purchasing Agent be authorized to enter into Contract Modification Number One.

Joint resolution authorizing a contract with Hoerr Construction Inc., Goodfield, Illinois, for sanitary sewer rehabilitation in the Fox Lake (Stanton Point) and Diamond Lake (West Shore) areas in the amount of $272,334.40 using a shared services contract with the Village of Mount Prospect.
· Public Works provides sewer service throughout portions of Lake County and undertakes rehabilitation of deteriorated and aging sanitary sewer systems.
· As part of the County’s shared services initiative, Public Works has been working closely with the County Administrator’s Office to identify shared service opportunities.
· In 2020, an invitation to bid on sewer lining was extended by the Village of Mt. Prospect on behalf of the participating Municipal Partnering Initiative (MPI) group members Mt. Prospect, Glencoe, Glenview and Winnetka.
· Hoerr Construction Inc. submitted the lowest responsive and responsible bid.
· Pursuant to Article 10-101 of the Lake County Purchasing Ordinance, Cooperative Purchasing, Lake County may participate in a cooperative purchasing agreement for the procurement of goods with one or more public procurement units in accordance with an agreement entered into between the participants.
· Lake County Public Works Department coordinated with members of the MPI group through their Sewer Lining Program to obtain the same 2020 contract pricing.
· Hoerr Construction Inc. submitted a quote to Lake County Public Works in the amount of $107,210.80 for 3,868 feet of sanitary sewer lining and associated work in the Fox Lake (Stanton Point) area.
· Hoerr Construction Inc. submitted a quote to Lake County Public Works in the amount of $165,123.60 for 5,906 feet of sanitary sewer lining and associated work in the Diamond Lake (West Shore) area.
· The combined total for the work covered by both quotes is $272,334.40.
· This resolution authorizes the execution of a contract with Hoerr Construction Inc. in the amount of $272,334.40.

STORMWATER MANAGEMENT COMMISSION

Resolution authorizing emergency appropriations for Fiscal Year (FY) 2020 for the local match portion of three Stormwater Management Commission projects in the amount of $210,771 as well as the remaining funds available of $270,063 previously dedicated by the County Board for floodplain buyouts in prior years.
· The floodplain buyout funds were inadvertently not “carried over” from FY2019 into FY2020.
· This emergency appropriation re-appropriates the funds for their intended purpose.
· $210,771 is proposed for local match of three known FEMA grants and the remainder will be utilized for additional flood-prone property buyouts.
· Additional authorization is sought utilizing these funds as direct match for FEMA grant needs.

Ordinance amending the Lake County Watershed Development Ordinance (WDO) to adopt the updated rainfall standards published by the Illinois State Water Survey and additional minor technical and administrative enhancements.
· On March 13, 2019, the Illinois State Water Survey published updated statewide rainfall statistics based on recorded precipitation observations. The intensity and frequency of heavy rainfall events in Lake County have significantly increased, up to 45 percent compared to current outdated standards.
· Over the past 18 months, the Stormwater Management Commission (SMC) and its advisory committees held 25 public meetings to develop, discuss, and approve 28 total amendments.
· The proposed amendments pertain to increased rainfall, stormwater detention options including incentives for green infrastructure, hydrologic soil groups, wetlands, sediments and erosion control, and administrative items.
· SMC approved a fee-in-lieu program for a portion of the detention storage above the new 50-year volume requirement. This optional program allows Certified Communities to collect development fees and expend funds for in-the-ground projects to resolve local, inter-jurisdictional, and regional drainage and flooding related problems.
PLANNING BUILDING AND DEVELOPMENT

Resolution directing the Lake County Zoning Board of Appeals to conduct a public hearing to consider proposed text amendments to the Unified Development Ordinance of Lake County, Illinois (Chapter 151 of the Lake County, Illinois Code of Ordinances) incorporating amendments to the Watershed Development Ordinance.
· The Stormwater Management Commission (SMC) has evaluated updated rainfall frequency data and has drafted corresponding amendments to the Watershed Development Ordinance (WDO). SMC’s draft also includes other miscellaneous amendments.
· In order to remain a SMC “Certified Community” in good standing, Lake County shall incorporate the WDO amendments, upon their adoption, into the Lake County Unified Development Ordinance (UDO) within 90 days.
· On March 13, 2001, the Lake County Board authorized the Planning, Building and Zoning Committee (PB&Z) to forward any future proposed UDO text amendments relating to WDO revisions directly to the Zoning Board of Appeals (ZBA) and to direct the ZBA to conduct a public hearing to consider such amendments. This Committee authority extends to the current Public Works, Planning and Transportation Committee.
· To minimize delay in considering corresponding UDO text amendments for unincorporated Lake County upon completion of the WDO amendment process, the attached Committee resolution directs the Zoning Board of Appeals to conduct a public hearing on such amendments at that time.

Committee action on Zoning Board of Appeals Case Number 000536-2019 for a Planned Unit Development (PUD) Final Development Plan for a self-service storage use (indoor/outdoor).
· Timothy James, record owner, previously petitioned for a rezoning from the Residential-(R-1) to the General Commercial (GC) District and for a Conditional Use Permit (CUP) for a PUD for a self-service storage use (indoor/outdoor). The subject property is a 22.50-acre parcel located at 25250 W. Old Rand Road, Wauconda, Illinois, Property Identification Number 09-36-400-009.
· The petitioners obtained approval of the rezoning and the CUP for a PUD and PUD Preliminary Plan by the County Board on August 11, 2020, subject to conditions relating to signage and open space preservation.
· Per Section 151.051 (C)(5) of the Lake County Code, approval of a PUD Preliminary Plan shall constitute approval of a CUP which, together with any zoning change accompanying the CUP, shall not become effective until any PUD Final Plan for the development is approved by the Committee and recorded.
· Staff has completed their review of the PUD Final Development Plan and recommends its approval.

Ordinance amending the Lake County Temporary Emergency Public Nuisance Ordinance.
· On May 12, 2020, the County Board adopted the Lake County Temporary Emergency Public Nuisance Ordinance to enact a temporary ban on open burning in the unincorporated area for a period extended from May 12 to June 10, coinciding with the spring landscape waste burning season. This ban was further extended by the County Board on June 9, July 14, and again on August 11, and is currently set to expire on October 14.
· The ordinance recognizes the increased risk of negative health impacts from open burning on individuals who have been infected with COVID-19.
· At the July Public Works Planning and Transportation Committee meeting, the Committee directed staff to prepare an amendment to the Temporary Emergency Ordinance to extend the ban subject to an exception allowing open burning on unincorporated residential properties at specified times and on limited days.
· At the August 11, 2020 County Board meeting, amendments to the Temporary Emergency Ordinance were adopted to allow burning of specified landscape waste and woody materials on Tuesdays, Thursdays, and Saturdays from sunrise to sunset, and continue to allow recreational fires and the use of self-contained outdoor burn devices under certain criteria.
· Since that time, Planning Building and Development staff has received feedback from several owners of large properties (five acres or greater) referring to difficulties encountered when attempting to dispose of their landscape waste within the parameters of the current Temporary Emergency Ordinance. As such, staff is returning to committee to propose a further amendment to the temporary ordinance to accommodate disposal on these properties.
· Staff’s proposed amendment will allow open burning of specified landscape waste and woody materials from sunrise to sunset on any day of the week if the burning occurs at least five hundred feet (500’) from a habitable structure.
· County Board action is anticipated on October 13.
· This amended temporary ordinance will go into effect immediately upon County Board adoption of Exhibit A and expire on December 31, 2020.
