C. ZONING, PLANNING AND APPEALS COMMISSION REPORT
1. Findings of Fact and Recommendation in the Docket 16-SU-S-1: 14341 W. Old School
Road, Application for an Amendment to an Existing Special Use Permit
Village Attorney Ferolo advised that the report and recommendation from the Zoning,
Planning and Appeals Commission came from their special meeting held on May 25, 2016.
Corporate Way had submitted an application to amend their special use permit to allow thetemporary use of the existing stable without an owner occupied single family residence
being completed and to allow a temporary dwelling unit to be built and used within the
stable until such time as the single family residence is completed and receives its certificateof occupancy. The ZPA has recommended approval of the amendment to the special usepermit. A draft ordinance has been presented to the Village Board which would approvethe amendment. It includes the condition that the residence can be used in the stable untilthe single family residence is completed, or eight months from the last permit issued inconjunction with the single family house. The other conditions include the temporaryresidence shall be built as approved by the Village Engineer and that the applicant mustapply for all permits related to the single family house within fourteen days of the approvalof the amendment.
Trustee Armstrong asked how we know what the last permit is related to the single family
house. Village Administrator Irvin advised that there are three permits involved with the
house and they include the engineering plans, septic plans and building plans. He said thatthose three specific permits could be added to the amendment if desired. Trustee
Armstrong said he just wanted to make sure that a later permit request connected to the

house would not extend the time period. He suggested that the three permits be added to
the amendment.
Trustee Maier asked if the punch list of items in the building report had been completed.
Village Administrator Irvin said that the applicant had submitted the plans for the
temporary residential build out last Friday, and Anderson has reviewed the plans and will
likely submit the building permit tomorrow. The builder has advised that it will take about
seven days to complete the work.
After discussion, the consensus of the Board was to add the specific permits to the
ordinance.
