1 Call to Order

The meeting was called to order at 7:00 p.m.

3.1 Meeting Minutes of February 28, 2017.

Motion to discuss corrections by Kristan, seconded by Waller. 

Page 2, Delete “Z.” 

Page 3 Mayor’s Comments, replace “his” with “this.”

Motion to approve the minutes, as corrected, by Monaco, seconded by Kristan.

6 New Business

6.1 Zoning Case 17-4: Petition for Variance on the property located at 375 N. Cedar Lake Road, Round Lake, IL to decrease the required ten foot setback from the rear lot line, by ten feet, and to decrease the required fifteen foot setback from the side yard, by fifteen feet to allow for a parking lot expansion, pursuant to Chapter 17.96.040 of the Municipal Ordinance. PIN: 06-29-104-004 

Petitioner: Delaine Birch, Trustee, Elaine Frangos Trust

Motion to open the public hearing by Kristan, seconded by Boyk.

Motion passed.

Village Attorney Kearney explained the Variation process.

Attorney Kearney swore in the petitioner, Delaine Birch, Trustee.

The Petitioner described the history, existing layout, and recent improvements made to the property. Ms. Birch informed the commissioners of the steep grade currently on the property and stated the pavement improvement would help in winter driving conditions.

It was asked if the parking lot would be re-graded to eliminate the steep hill. Ms. Birch stated they were not going to re grade as it may cause hardship to surrounding properties.

It was asked if the existing parking lot was over the property lines. Ms. Birch stated she has not had it surveyed but have found the pins and do not believe they are over the property lines.

It was asked if there are any utility easements in the rear yard. Ms. Birch stated not that she is aware of. Commissioners and staff discussed if the improvements were made to the lot, the petitioner would be responsible if any improvements to any possible easements were needed.

Motion to close the public hearing by Kristan, seconded by Monaco.

Commissioners discussed setting a condition subject to any rights to any easements existing on the property.

Motion to approve the petition for Variance, subject to any existing easements on the property for Zoning Case 17-4 at 375 N. Cedar Lake Road, by Kristan, seconded by Silvestri.

Motion to direct the Village Attorney to prepare the Findings and Recommendations for Zoning Case 17-4, to the Mayor and Board of Trustees, by Silvestri, seconded by Waller.

6.2 Zoning Case 17-5: Public Hearing for Revocation of Special Use 11-O-01, granted to Elizabeth Valdez of Tony’s Auto Repair, permitting an automotive/motor vehicle/mechanic facility at 758 Magna Dr., Unit C, Round Lake, IL. Zoning District: I-1 PIN: 06-20-303-003 Petitioner: Village of Round Lake

Motion to open the public hearing by Monaco, seconded by Waller.

7 Commissioner’s Comments: It was asked what the reason for tabling the Special Use Revocation was. Attorney Kearney stated we were informed that the business owner recently had a baby and we received a very late request from the business owner’s attorney. This will be the only extension granted at the business owners request.
