Village of Cary Committee of the Whole met June 4.

1. Call to Order
This meeting was called to order at 6:12 p.m. by Mayor Kownick.
II. Roll Call
Present: Mayor Kownick, Trustees McAlpine, Betz, Covelli, Weinhammer, Kraus and Collier
Absent: None
Others present included Village Administrator Rife, Community Development Director Simmons, Public Works Director Morimoto, Police Chief Finlon, Management Analyst Sage, Village Attorney Uhler and members of the audience per the sign-in sheet.
III. Pledge of Allegiance
Mayor Kownick led in the recitation of the Pledge of Allegiance.
iv. Public Comments
There being no comments from the public, Mayor Kownick closed Public Comments at 6:13 p.m.
V. Public Hearing – Consider for Approval a Variance for an Additional Wall Sign and Variance for Illuminated Canopy Signs for the Thorntons Gas Station to be Located at 104 Northwest Highway Director Simmons provided an overview of the variance requests.
Trustee McAlpine asked about the open area of the parcel and if there would be an approval process once Thorntons had a design plan for it. Director Simmons stated any major modifications proposed for the open area of the site would require planned use development approval by the Village Board. Trustee McAlpine stated she would like the petitioner to consider moving the monument sign facing Jandus Cutoff further away from Rt. 14 since the other monument sign directly faces Rt. 14.
Attorney Uhler swore in meeting attendees who wished to provide statements at the public hearing.
Dave Miller, Lake Julian, 65 Northwest Highway, stated he does not support the Thorntons gas station due to lighting issues and feels there are better uses for this parcel.
The petitioner Troy Paionk, BSTP Midwest, LLC, provided information regarding the variance requests and stated the sign facing Jandus Cutoff will be moved further down Jandus Cutoff, away from Rt. 14.
It was the consensus of the Committee of the whole to forward on to the June 18, 2019 Village Board Meeting the consideration for approval a variance for an additional wall sign and variance for illuminated canopy signs for the Thorntons Gas Station to be located at 104 Northwest Highway.
VI. Discussion Regarding the Operation of Non-Highway Vehicles on Streets within the Jandus Subdivision
Chief Finlon provided an overview of the requirements for usage of non-highway vehicles on streets.
Trustee Kraus asked if residences in Cary within the Trout Valley Association are allowed to use golf carts. Director Morimoto stated yes, because the portions of the neighborhoods that are in both Cary's corporate limits and part of the Trout Valley Association are all private roadways, which are not restricted regarding golf cart usage.
Mayor Kownick resident Dana Turskey sent an email to Trustee McAlpine supporting the usage of non highway vehicles within the Jandus subdivision.
Trustee Covelli asked Chief Finlon if allowing the use of non-highway vehicles on streets within the Jandus subdivision would have an impact on the police department. Chief Finlon stated he did not believe it would not have a significant impact.
Trustee Collier asked Chief Finlon how enforcement would be handled. Chief Finlon stated an officer could perform a traffic check after observing the usage of a non-highway vehicle.
It was the consensus of the Committee of the whole to forward on to the June 18, 2019 Village Board Meeting the consideration for approval an ordinance permitting the operation of non-highway vehicles on streets within the Jandus subdivision.
VII. Discussion Regarding Participation in the McRide Dial-A-Ride Service
Director Morimoto and Management Analyst Sage provided an overview of the McRide Dial-A-Ride service, Pace Dial-A-Ride program and the Algonquin Township Senior Transportation program.
The Village Board asked staff to gather additional information on the McRide program and the Pace program.
It was the consensus of the Committee of the whole to continue discussion regarding transportation programs at a future meeting.

Mayor Kownick entertained a motion to enter into Executive Session for the purpose of discussing Litigation: Pending or Imminent, 5 İLCS 120/2(c)(11), Personnel: Collective Bargaining, 5 ILCS 120/2(c)(2), Personnel: Appointment, Employment, Compensation, Discipline, Performance or Dismissal of Specific Employees, 5 ILCS 120/2(c)(1) and Closed Session Minutes, Review, 5 ILCS 120/2(c)(21).
Motion:
Trustee McAlpine moved, seconded by Trustee Weinhammer to adjourn into Executive Session for the purpose of discussing Litigation: Pending or Imminent, 5 ILCS 120/2(c)(11), Personnel: Collective Bargaining, 5 ILCS 120/2(c)(2), Personnel: Appointment, Compensation, Discipline, Performance or Dismissal of Specific Employees, 5 ILCS 120/2(c)(1) and Closed Session Minutes, Review, 5 ILCS 120/2(c)(21).
Ayes: All ayes by voice vote
Nays: None
Motion Carried.
Mayor Kownick and Trustees Covelli, Betz, Collier, Kraus, McAlpine and Weinhammer entered into Executive Session at 7:27 p.m. Others present included Village Administrator Rife, Chief Finlon and Village Attorneys Scott Uhler and Mallory Milluzzi.
After discussion, Mayor Kownick entertained a motion to exit Executive Session.

Trustee Kraus moved, seconded by Trustee Covelli to exit Executive Session at 7:57 p.m.
Ayes: All ayes by voice vote
Nays: None
Motion Carried.
IX. Adjourn
There being no further items to discuss, a MOTION was made to adjourn the meeting at 7:58 p.m.
