Village of Wauconda Special License & Administration Committee met Oct. 22.

Here is the minutes provided by the committee:

1. CALL TO ORDER

Deputy Chair Howe called the meeting to order at 5:34 p.m.

2. PUBLIC COMMENT

There was no public comment.

3. OLD BUSINESS

a. Draft Zoning Ordinance Text Amendment – Cannabis Business Establishment Regulations Deputy Chair Howe began the discussion by reviewing the Committee’s previous work regarding the Cannabis Regulations and Tax Act. He stated that the Committee previously provided staff with guidelines for drafting a text amendment to the Village zoning code relative to the new law. He continued that the Village is targeting a December 2019 Village Board approval for the proposed zoning code text amendment.

The Committee reviewed a memorandum provided by the Village Planning and Zoning consultant, Rolf Campbell and Associates, which outlined proposed zoning code text amendments based on the previous direction of the Committee. The Committee discussed various changes to the proposed text amendment, including:

• Chapter 155.022 – Separating cannabis cultivation centers on the permitted use table and allowing this use in the LI and AG zones with a conditional use permit.

• Chapter 155.022 – Removing language that excludes property in the zones on Main Street from Minerva to Wilton.

• Chapter 155.043(l)(2) – Removing the phrase “community deleterious prevention plan” from the submittal requirements.

• Chapter 155.043(l)(3)(a) – Removing “open space” and “forest preserves” from the minimum setbacks section.

• Chapter 155.043(l)(3)(b) – Removing this section regarding cultivation center setback requirements.

• Chapter 155.043(l)(4)(a)(1) – Amending the minimum number of parking spaces from 100 to 25 for cannabis dispensaries.

• Chapter 155.043(l)(6) – Removing this section regarding building requirements.

• Chapter 155.043(l)(7) – Removing this section regarding landscaping requirements.

• Chapter 155.043(l)(9)(a) – Adding language regarding compliance with the advertising provisions of the Cannabis Regulation and Tax Act.

• Chapter 155.043(l)(9)(c) – Removing the phrase “other than ‘marijuana’ or ‘cannabis’”.

• Chapter 155.043(l)(9)(d) – Removing this section regarding the posting of signage at dispensary entrances.

• Chapter 155.043(l)(13) – Removing this section regarding security and video surveillance.

• Chapter 155.043(l)(14) – Removing this section regarding conduct on site.

• Chapter 155.043(l)(15) – Removing this section regarding air treatment.

• Chapter 155.043(l)(16) – Removing this section regarding cannabis waste.

• Chapter 155.043(l)(17) – Changing “code official” to “Zoning Enforcement Officer”.

• Chapter 155.043(l)(18) – Amending the number of allowed cannabis business establishments to two (2) per type of establishment.

• Chapter 155.043(l)(20) – Removing this section regarding random inspections.

• Chapter 155.043(l)(21) – Removing this section regarding penalties.

• Chapter 155.047(a) – Amending the number of parking spaces to reflect the changes in section 155.043(l)(4)(a)(1) and adding the cannabis business establishment uses.

Village Attorney Magna provided the Committee with a review of the various licensing options available to the Village for the regulation of cannabis business establishments in the Village, specifically as it relates to the time, place, and manner of operations.

After further discussion, Deputy Chair Howe requested that the discussed changes to the zoning code text amendment be incorporated into a draft ordinance for consideration by the Committee at a special meeting on October 29, 2019. He also requested that Village

Attorney Magna prepare licensing options for consideration by the Committee at a future meeting.
