 Village of Deerfield Board of Trustees met June 5.

The regular meeting of the Board of Trustees of the Village of Deerfield was called to order on June 5, 2023, at 7:30 p.m. at Deerfield Village Hall. The clerk called the roll and announced that the following were

Present: Dan Shapiro, Mayor

Robert Benton

and that a quorum was present and in attendance. Also present were Village Manager Kent Street and Steven Elrod, Village Attorney.

MOMENT OF SILENCE Those in attendance observed a moment of silence in memory of Maureen Wener. Ms. Wener was struck by a motor vehicle while riding her bike. Mayor Shapiro stated the community will mourn this tragic death and miss her spirit. Trustee Seiden expressed his support for the Wener family and appreciation for knowing her through the Library Board. The Board wishes sincere condolences to her family. The funeral services will be at BJBE tomorrow at noon. Shiva will be until 8:00 p.m. at Briarwood Country Club.

PLEDGE OF ALLEGIANCE Ann McAuliffe and Sue Ginsburg led those in attendance in reciting the Pledge of Allegiance.

PROCLAMATION Mayor Shapiro proclaimed the month of June 2023 as Lesbian, Gay, Bisexual, Transgender and Questioning Pride Month in the Village of Deerfield, and encouraged all community residents to eliminate prejudice wherever it exists and to recognize our great diversity by celebrating our LGBTQ friends and neighbors.

Trustee Benton moved to accept the Proclamation. Trustee Metts-Childers seconded the motion. The motion passed unanimously on a voice vote.

PFLAG members Ann McAuliffe and Sue Ginsburg thanked the Board for their continued support. PFLAG is celebrating their 50th anniversary of supporting, educating and advocating for the LGBTQ community. Ms. Ginsburg noted corporate sponsors are important to PFLAG and thanked their corporate sponsors. Ms. McAuliffe stated they are always striving for equality and to lead with love. Ms. Ginsburg and Ms. McAuliffe praised Deerfield as a safe and accepting community. Ms. McAuliffe reported that PFLAG’s new branding initiative is Branding with Love. They will be attending the Chicago Pride Parade and will have a booth at the June 17 Deerfield Farmers Market.

DOCUMENT APPROVAL Trustee Oppenheim moved to approve the minutes from the May 15, 2023, Board of Trustees meeting and the May 22, 2023, Committee of the Whole meeting. Trustee Berg seconded the motion. The motion passed unanimously on a voice vote.

TREASURER’S REPORT Director of Finance Eric Burk presented highlights from the April 2023 Treasurer’s Report representing one-third of the fiscal year. Mr. Burk reported net sales tax decreased from last month, which is typical this time of year, as receipts are related to January sales. He noted water and sewer billings continue to reflect lower usage months. Mr. Burk stated hotel tax includes back payment from one hotel and current payments from all six hotels. Mr. Burk reported a portion of Cook County property tax was received. He noted notable expenditures in April include construction and engineering costs and new pay stations at commuter parking lots. General liability insurance and debt service payments are scheduled for May. Mr. Burk noted the Village will be receiving more money from the State this year.

BILLS AND PAYROLL Trustee Seiden moved to approve the bills and payroll dated June 5, 2023. Trustee Benton seconded the motion. The motion passed by the following vote:

AYES: Benton, Berg, Jacoby, Metts-Childers, Oppenheim, Seiden (6)

PUBLIC COMMENT There were no Public Comments on non-agenda items.

REPORTS

CONSIDERATION AND ACTION ON A REPORT AND RECOMMENDATION OF THE BOARD OF ZONING APPEALS CONCERNING THE REQUEST FOR RELIEF FROM ARTICLE 2.03-D, (3) & (5) OF THE DEERFIELD ZONING ORDINANCE FOR THE PROPERTY LOCATED AT 855 FAIR OAKS AVE. TO PERMIT THE CONSTRUCTION OF A DETACHED TWO CAR GARAGE SIX FEET FROM THE PRINCIPAL STRUCTURE IN LIEU OF THE MINIMUM TEN FEET AND SIDE AND BZA REAR PROPERTY LINES OF TWO FEET IN LIEU OF FIVE FEET SPECIFIED IN THE DEERFIELD ZONING ORDINANCE THE DEERFIELD ZONING ORDINANCE 

The BZA held a Public Hearing on May 16, 2023, to consider the request of petitioners Tom and Kaitlyn Zelski who requested permission to construct a 22 x 26 foot detached two-car garage in place of their existing 12.25 x 18.45-foot substandard garage located in the southeast corner of their property. The proposed garage would allow room for two vehicles and equipment storage and would encroach 4-feet into the 10-foot minimum  detached structure and principal structure required separation and to within 2-feet of the side and rear property lines, in lieu of the minimum 5-feet. The concluded the requested variation was based on a reasonable use of the land and satisfied the  Standards for Variation specified in Chapter 13 of the Zoning Ordinance. The BZA voted 6-0 in favor of sending a favorable recommendation to the Board.

Architect Andrew Venamore stated the request is for a replacement garage. He noted the existing structure is actually a large shed that is not accessible for a vehicle. Mr. Venamore stated the project would include constructing a useful-size structure to house two vehicles and provide some storage. He noted the home is very quaint and does not have space for storage. He stated the owners plan on using part of the garage for lawn equipment and basic storage. Mr. Venamore reported the owners want to use the location of the existing shed and mirror the architecture of the house. Mr. Venamore noted the garage width was widened to allow for a turning radius, but the west garage bay will still be very tight.

Trustee Oppenheim ensured the drainage requirements were met. Mr. Venamore reported they received preliminary approval. Trustee Oppenheim noted the adjacent structure on the adjoining property is also a garage.

Trustee Oppenheim moved to accept the report and recommendation of the BZA for the property located at 855 Fair Oaks Avenue to permit the construction of a two-car garage and to prepare the Ordinance. Trustee Benton seconded the motion. The motion passed by the following vote:

AYES: Benton, Berg, Jacoby, Metts-Childers, Oppenheim, Seiden (6)

CONSENT AGENDA

ORDINANCE 0-23-12 AMENDING SECTION 5-32 OF THE MUNICIPAL CODE REGARDING DOG LEASH REGULATIONS

An Ordinance amending the Municipal Code regarding dog leash regulations. The existing regulations require dogs to be confined to a leash of not more than three feet. Staff recommends amending the Code to match long-standing past practices and permit dogs to be confined to a six-foot leash.

RESOLUTION R-23-26 APPROVING AN APPLICATION BY KIRBY LIMITED PARTNERSHIP (728 WAUKEGAN RD) FOR PARTICIPATION IN THE BUSINESS FAÇADE REBATE PROGRAM

A Resolution approving participation in the business façade rebate program for Kirby Limited Partnership located at 728 Waukegan Road. 

RESOLUTION R-23-27 APPROVING A LCDOT MUNICIPAL FACILITY AGREEMENT WITH THE LAKE COUNTY DIVISION OF TRANSPORTATION TO ALLOW FOR THE PLACEMENT OF AN ALPR READER CAMERA ON DEERFIELD ROAD

A Resolution approving an agreement with to allow the placement of an ALPR reader camera on Deerfield Road. The agreement will allow for the placement of one License Plate Reader to be used for the detection and prevention of criminal activity.

Trustee Metts-Childers moved to accept the Consent Agenda and adopt the Resolutions and Ordinance. Trustee Berg seconded the motion.

Trustee Oppenheim noted there is a discrepancy in the landscaping for Deerfield Square. She noted the Board had previously requested more native, non-exotic species in the landscaping and that ownership was in agreement. She pointed out that the included plant list shows exotic, non native plantings. Trustee Oppenheim asked if a change was made. Assistant Village Manager Andrew Lichterman reported they spoke with ownership about this and ownership has agreed to include the native plantings. Mr. Lichterman noted the approval in the submittal was the ARC approval. He stated that when they apply for the permits, the Village will ensure the native plantings are included.

Trustee Benton asked whether an electronic fence is included in the dog leash regulations Ordinance. Mr. Lichterman reported dogs do not need to be leashed in their yard with a visible or invisible fence.

The motion passed by the following vote:

NEW BUSINESS

ORDINANCE O-23-13 AMENDING SECTION 7-15 OF THE DEERFIELD MUNICIPAL CODE OF 1975, AS AMENDED, REGARDING PEDDLERS AND SOLICITORS 

An Ordinance amending the Municipal Code regarding peddlers and solicitors. The current solicitor permit application requires applicants to self-report any felony convictions in the past 10 years, any misdemeanor convictions in the past five years in addition to any Ordinance violations for soliciting.

Mr. Lichterman reported staff conducted a review of current solicitor permit regulations and determined that requiring applicants to obtain a background check is in the best interests of the Village and residents. The Ordinance amends the Municipal Code to add a provision that solicitor permit applicants must submit background check results from the Illinois State Police Bureau of Identification. The background check results must be obtained from a State-approved Livescan vendor within 90 days prior to submitting the application.

Trustee Benton moved to adopt the Ordinance amending Section 7-15 of the Municipal Code regarding peddlers and solicitors. Trustee Oppenheim seconded the motion. The motion passed by the following vote:

AYES: Benton, Berg, Jacoby, Metts-Childers, Oppenheim, Seiden (6)

DISCUSSION

MEMORIAL DAY CEREMONY 

Mayor Shapiro was thrilled to participate in the Memorial Day Ceremony last Monday. He noted that it was very rewarding.

ART FESTIVAL RECAP 

The Deerfield Festival of the Arts was held on June 3, 2023, and June 4, 2023, and was a huge success. Mayor Shapiro thanked staff for their assistance.

FARMERS MARKET 

The first Farmers Market will take place on June 10, 2023, starting at 7:00 a.m. There are more than 35 vendors participating this year.

SENATOR JULIE MORRISON 

Senator Morrison moved her office to 400 Lake Cook Road. Mayor Shapiro thanked her for her help on SB234, which allows for the use of drones for large gatherings and events.

RIBBON CUTTING 

The Brick & Mortar ribbon cutting will be held on Wednesday, June 14 from 5:00 p.m. to 7:00 p.m.

FAMILY DAYS UPDATE 

Public Works Analyst Ryan Oates reported the 60th annual Family Days event will be held at Shepard Park on July 3rd. He noted the event will feature music, bounce equipment, crafts and fireworks. Mr. Oates reported most of the July 4th events will be held at Jewett Park, including the Rotary Race, carnival games, music, crafts, food vendors, a sensory play area and parade. Mr. Oates noted that due to the construction on Waukegan Road, the parade route will start at Deerspring Pool and end at Jewett Park. He reported there will be at least 40 vendors at the parade including a 145-person band. Mr. Oates stated the commissioners got 30 sponsors to contribute and raised more than $10,000.

There being no further business or discussion, Trustee Oppenheim moved to adjourn the meeting. Trustee Berg seconded the motion. The motion passed unanimously on a voice vote. The meeting was adjourned at 8:08 p.m.

The next regular Board of Trustees meeting is scheduled to take place on Tuesday, June 20, 2023, at 7:30 p.m.
