District 128 assures student rights amid evolving federal policies

Community High School District 128 has affirmed its commitment to providing a safe, inclusive, and high-quality education for all students amid concerns arising from recent Executive Orders. In a message addressed to D128 parents and guardians on January 31, 2025, Co-Interim Superintendents Raymond Lechner, Ph.D., and Rebecca Nelson, Ph.D., sought to reassure families and staff by addressing potential anxieties about the evolving policy landscape.

The district emphasized its adherence to federal and state laws while highlighting that the fundamental rights of all students remain unchanged regardless of immigration status. The superintendents stated: "Every student has the right to attend school. We will not deny enrollment or discriminate based on immigration status. "

D128 clarified that it does not request or maintain information regarding the immigration status of students or their families. Additionally, all student records are protected under the Family Educational Rights and Privacy Act (FERPA), with no identifying information shared without parental consent unless mandated by a valid court order.

In situations where immigration or law enforcement agencies visit schools unexpectedly, district administration will adhere to established D128 policies designed to protect student and family privacy while supporting law compliance. Law enforcement agents would only be permitted entry into school buildings upon presenting a valid judicial warrant signed by a judge.

The district also addressed inquiries concerning potential impacts of new Executive Orders on funding, programs, and curriculum. Referring to a January 30, 2025 message from State Superintendent Tony Sanders sent Illinois public schools: "These actions do not require school districts to make any immediate changes at the board or classroom level. At this time there have been no changes to federal legislation regulations or funding that would warrant a local response and all Illinois state laws remain intact."

Parents were encouraged to reach out for further support if needed through Libertyville High School LST Vernon Hills High School LST Transition Pathways teams who are available for guidance.
