Village of Cary Committee of the Whole met April 17.

Here is the minutes provided by the Committee:

I. Call to Order This meeting was called to order at 6:17 p.m. by Mayor Kownick.

II. Roll Call

Present: Mayor Kownick and Trustees Covelli, Weinhammer, Betz, Kraus, McAlpine and Cosler

Absent: None

Others present included Public Works Director Morimoto, Community Development Director Simmons, Police Chief Finlon, Management Analyst Sage, Village Attorney Uhler and members of the audience per the sign-in sheet.

III. Pledge of Allegiance

Mayor Kownick led in the recitation of the Pledge of Allegiance.

IV. Public Comments

Mary Hall, 937 Woodbridge, recently moved to the Village of Cary and wanted to say how pleased she has been with the service and helpfulness of Village employees, specifically Officer Eichhorn and John Fitch, Building Official.

V. Discussion on Solicitor Ordinance

Discussion-

Chief Finlon provided an overview of the current solicitor ordinance and court decisions that relate to prior discussions by the Board of possible changes to the ordinance. Chief Finlon stated per Village ordinance, the occupant determines whether solicitors shall be invited to the residence. Residents have the option of placing a No Solicitors Invited sticker or sign on their residence.

Attorney Uhler stated 9:00 p.m. is the generally accepted end time for soliciting.

Trustee Covelli asked if homeowners associations are able to restrict soliciting. Attorney Uhler stated this was possible if 100% of the homeowner association members were in agreement.

Trustee Weinhammer stated she supports background checks for solicitors applying for a permit.

Chief Finlon asked Attorney Uhler about reimbursement by solicitors for fees such as background checks. Attorney Uhler stated that solicitor permit fees are generally not permissible unless the municipality can justify its expenditures, however, exceptions for non-profits can be adopted.

It was the consensus of the Committee of the Whole to continue the discussion in a future meeting.

VI. Adjourn

There being no further items to discuss, a Motion was made to adjourn the meeting at 7:18 p.m.

Second: Trustee Cosler

The Voice Vote noted all ayes and the motion carried.
