Meeting called to order at 7:00 p.m.

REVIEW/APPROVAL OF MINUTES

Motion by J. Herchenbach, seconded by S. Schneckloth to approve the Planning and Zoning Commission Meeting minutes of May 15, 2019.

Chairman Roswick read the following statement into the meeting minutes.

"At the last meeting of the Planning and Zoning Commission, I inadvertently failed to ask for a motion and a vote to open the public hearing held within that meeting. Peter Vadopalas has consulted on this matter with one of the attorneys for the Village, Charles Marino, who has advised that, in his opinion, this was a technical omission that does not affect the legality of the hearing."

PUBLIC HEARING – PZC‐06‐2019 – 1080 ASTER COURT

Motion by J. Herchenbach, seconded by K. Garesche to open Public Hearing PZC‐06‐2019.

T. Wegrzyn, Planner, gave an overview of the variation request. The property owners are seeking a variance to construct a gazebo that is approximately 222 square feet. The Zoning Ordinance limits gazebos and similar accessory structures to a maximum of 144 square feet in area. Therefore, the proposed gazebo is 78 square feet larger than what is permitted. The petitioner has stated that the additional square footage is needed to accommodate their large family within an outdoor space free from mosquitos.

SWEAR IN PETITIONER(S)

Vlayd Kryvdyk (26 W. Maple Avenue) spoke on behalf of his father, Igor Kryvdyk, property owner and petitioner. The property owners wish to construct a gazebo in their back yard that allows them a place to enjoy the outdoors with their extended family while staying away from mosquitos.

COMMISSION DISCUSSION

Commissioner Garesche stated that she had no objections to the request.

The Commissioners discussed the character of the neighborhood, lot sizes, and placement of the structure on the property, and accessory structure size as a whole. Lots are larger in this neighborhood therefore a gazebo of this size would not appear out of place. Other properties have pools, raised decks and patios.

The Commission asked the petitioner if an addition to the home, a three season room or screened porch, was considered as it could be done without seeking a variance. The petitioner stated it had been considered, however, it was too expensive.

Commissioner Herchenbach asked what the base (floor) would be made of. The petitioner stated the structure would sit on top of a concrete slab.

Motion by J. Herchenbach, seconded by S. Schneckloth to recommend approval of a variation from Section 20.52.040(A) of the Zoning Ordinance to allow for a gazebo greater than 144 square feet in area on the property located at 1080 Aster Court.

FINDINGS OF FACT – PZC‐05‐2019, 1317 HUNTINGTON DRIVE

Motion by J. Herchenbach, seconded by K. Anderson to Approve the Findings of fact as Published for PZC‐05‐2019 Relating to a Special Use Permit for a Solar Energy System for Vivint Solar at 1317 Huntington Drive.

PUBLIC MEETING PZC‐07‐2019 – BIG DOOR, 0 WILHELM ROAD

T. Wegrzyn, Planner, gave a brief history of the request for plat approval. Big Door Holdings, LLC received a Conditional Special Use Permit on September 24, 2018 to allow for a garage storage facility on the subject property which is located on Wilhelm Road. The property is currently subdivided into three separate parcels and it is the desire of the property owners to consolidate these into a single parcel with certain easements to facilitate the development of the proposed three‐building garage storage facility. It is the intent of the petitioner, upon substantial completion of the buildings, to create a plat of condominium with a condominium declaration to further delineate the future individual ownership of the units.

Motion by R. Rose, seconded by J. Herchenbach to recommend approval of Big Door Plat of Resubdivision.

PUBLIC MEETING PZC‐07‐2019 – 710 NORTON AVENUE

T. Wegrzyn, Planner, gave a brief history of the request for plat approval. On January 16, 2019, the Planning and Zoning Commission considered certain requests for a detached garage at 710 Norton Avenue. The PZC recommended approval of certain variations and recommended certain conditions that were also approved by the Village Board. One of the conditions stated: “Prior to the issuance of a building permit, the Petitioner shall cause a Plat of Consolidation to be submitted to the Village that consolidates the three (3) lots on the Subject Property into one lot.”

Motion by J. Herchenbach, seconded by R. Rose to recommend approval of the Final Plat of Sorby Consolidation for the property at 710 Norton Avenue.
